Terms of Service

These Terms of Service ("Terms") govern your use of the KobyCopy desktop application and the kobycopy.com website (together, the "Service"). By downloading, installing, or using KobyCopy, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

"KobyCopy", "we", "us", and "our" refer to the operator of the Service. You can reach us at copykoby@gmail.com.

2. What the Service does

KobyCopy is a desktop application that rewrites text you select in other apps using an AI model of your choice. You pick which AI provider to use (for example, Anthropic Claude, OpenAI, or the bundled offline model), and the app sends rewrite requests directly from your machine to that provider.

3. Eligibility and account

You must be at least 13 years old to use KobyCopy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Tell us right away if you suspect unauthorized access.

4. Free trial, subscription, and billing

• Trial. New accounts receive a 7-day free trial with full access. No credit card is required to start the trial.
• Subscription. To continue using KobyCopy after the trial, you must start a paid subscription. Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for your plan.
• Price changes. We may change prices. If we do, we'll give you reasonable advance notice. Any change will take effect at the start of your next billing period. Early-bird pricing, if you subscribed during that window, is locked in for as long as you remain continuously subscribed.
• Cancellation. You can cancel at any time through the in-app billing portal or by emailing us. Cancellation stops future charges. Your subscription remains active until the end of the current billing period.
• Refunds. Payments are non-refundable except where required by law. If you cancel mid-period, you keep access for the remainder of that period but we do not prorate refunds for unused time.
• Failed payments. If a charge fails, we may retry the charge and, if it continues to fail, pause or terminate your subscription.
• Taxes. Prices do not include taxes. You are responsible for any applicable taxes.

5. Acceptable use

You agree not to use the Service to:

• Violate any law, regulation, or third-party right.
• Generate content that is illegal, harassing, hateful, or that targets or harms minors.
• Impersonate others, spread misinformation, or deceive people about the origin of AI-generated content in ways that would cause harm.
• Attempt to circumvent the app's licensing, sign-in, or payment systems.
• Reverse engineer, decompile, or disassemble the app except to the extent applicable law expressly permits.
• Use the Service to train a competing model or to bulk-scrape outputs at scale.
• Violate the terms of service of any AI provider you connect (Anthropic, OpenAI, or others). Their rules apply to your use of their models.

6. Your content

You keep all rights to the text you rewrite with KobyCopy. We do not claim ownership of your copy, and we do not use your copy to train models or improve our Service. Because your rewrite requests are sent directly to your chosen AI provider, their handling of that content is governed by their terms, not ours.

7. AI output and accuracy

AI-generated text can be wrong, biased, or unfit for your purpose. You are responsible for reviewing and editing every rewrite before you publish, send, or rely on it. Do not treat AI output as legal, financial, medical, or professional advice. We make no guarantee that any rewrite will be accurate, original, or suitable for any particular use.

8. Our intellectual property

The Service, including the KobyCopy name, logo, mascot, website design, and application code, is our property or licensed to us and is protected by copyright, trademark, and other laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the app for your personal or business writing during your subscription. It does not transfer ownership.

9. Third-party services

KobyCopy integrates with third-party services that you select (AI providers, payment processor, and others). We are not responsible for those services. Your use of them is subject to their own terms and privacy policies. Outages, changes, or failures in third-party services may affect KobyCopy's functionality.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY OUTPUT WILL BE ACCURATE OR MEET YOUR EXPECTATIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOBYCOPY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or if we discontinue the Service. On termination, your right to use the Service ends, but any provisions that by their nature should survive (such as disclaimers, limitation of liability, and indemnification) will survive.

14. Governing law

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located there, and you consent to personal jurisdiction in those courts.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the effective date at the top and, where appropriate, notify you by email or in the app. Continued use of the Service after changes means you accept the updated Terms.
